Notice of the Department of Environmental Management, Solid Waste Management Board, announces the rescheduling of the hearing on an April 14, 2011, proposed rule that amends regulations under 329 IAC 3.1-11-2 and adopts regulations under 329 IAC 3.1-11.1 concerning the temporary storage and management of spent lead acid batteries. The rule sets forth requirements for the management of spent lead acid batteries, including transportation and storage, by retailers, wholesalers, manufacturers, auto salvage yards, other storage facilities, and reclamation facilities. The rule also addresses the intermittent storage of partially reclaimed spent lead acid batteries. In addition, the rule adds definitions; adds a notification requirement for intermediate storage facilities that accumulate more than 5,000 kilograms of spent lead acid batteries; and clarifies closure and corrective action requirements for permitted and unpermitted storage areas.
