- Proposed rule of the Albuquerque/Bernalillo County Air Quality Control Board amends regulations under 20.11.100 NMAC regarding decentralized motor vehicle emissions inspections. The rule clarifies the new motor vehicle exemption period as four years rather than two registration cycles, exempts vehicles 35 years or older, allows for the limited use of mobile test units for the onsite testing of 1996 and newer fleet and dealer lot vehicles, and returns 1975 through 1985 model year vehicles from annual to biennial testing. The rule also requires testing of hybrid vehicles if purchased after the effective date of the amended regulation or upon change of ownership, provides for the testing of diesel vehicles beginning Jan. 1 of the year following the adoption of a more stringent federal ozone standard, and removes the $300 repair cost threshold for time extensions for individuals on public assistance. In addition, the rule moves the enforcement and appeals sections from the Procedures Manual to 20.11.100 NMAC and changes the manual from a regulatory document to a technical guidance document. The rule will be submitted to EPA as a revision to the state implementation plan. A hearing is scheduled for May 11, 2011, in Albuquerque. Comments are due May 4, 2011.
